DINO – TERMS OF USE

These Terms of Use constitute a legally binding agreement between you and Magicbook Technologies Lda.
By accessing or using Dino, you agree to these Terms.
1. Service Description
Dino allows users to upload drawings and generate animated educational content using automated systems.
Magicbook may modify, suspend, or discontinue the service at any time without notice.
2. Eligibility & Supervision
Children may only use Dino under the supervision of a parent, legal guardian, or educator.
Magicbook assumes no responsibility for unsupervised use by minors.
3. Accounts
You are responsible for:
- Maintaining account security
- All activity conducted under your account
Magicbook may suspend or terminate accounts at its sole discretion.
4. User Content & License
You retain ownership of drawings you upload.
By uploading content, you grant Magicbook a worldwide, non-exclusive, royalty-free, sublicensable license to:
- Process
- Reproduce
- Modify
- Display (internally)
- Use content as necessary to operate and improve the service
This license survives account termination to the extent required for legal and operational purposes.
5. Prohibited Conduct
You may not:
- Upload illegal, harmful, or infringing content
- Use Dino for commercial exploitation without permission
- Attempt to reverse engineer, copy, or disrupt the service
- Circumvent security or access controls
Violations may result in immediate termination.
6. Intellectual Property
All Dino software, algorithms, animations, interfaces, branding, and documentation are the exclusive property of Magicbook Technologies Lda.
No rights are granted except as expressly stated.
7. Educational Disclaimer
Dino provides supplementary educational content only. Magicbook makes no guarantees regarding educational outcomes, accuracy, or suitability for specific learning needs.
8. Disclaimer of Warranties
Dino is provided “as is” and “as available”.
Magicbook disclaims all warranties, including implied warranties of:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
9. Limitation of Liability
To the maximum extent permitted by law, Magicbook shall not be liable for:
- Indirect or consequential damages
- Loss of data
- Loss of profits
- Educational, behavioral, or developmental outcomes
Total liability shall not exceed the amount paid (if any) for the service in the preceding 12 months.
10. Indemnification
You agree to indemnify and hold harmless Magicbook Technologies Lda from any claims arising from:
- Your use of Dino
- Content you upload
- Violation of these Terms
11. Termination
Magicbook may suspend or terminate access at any time, with or without cause.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of Portugal. Portuguese courts shall have exclusive jurisdiction.
